1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of DomainSMP's Minecraft server, website, and related services (collectively, the "Services").

You acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Age Requirements & Parental Consent

2.1 Minimum Age

You must be at least 13 years old to use our Services (COPPA compliance).

2.2 Ages 13-17

If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2.3 Verification

We reserve the right to verify age and request proof of parental consent at any time.

3. Account & Registration

3.1 Minecraft Account Required

You must own a legitimate Minecraft account to use our Services. We do not support cracked or pirated accounts.

3.2 Account Security

You are responsible for:

• Maintaining the security of your account
• All activities that occur under your account
• Notifying us of unauthorized access

3.3 Account Sharing Prohibited

Account sharing is strictly prohibited. Each player must use their own account.

3.4 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Purchases, Payments & Refunds

4.1 Virtual Goods

All ranks, crates, and items are virtual goods with no real-world monetary value.

4.2 Payment Processing

Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms and conditions.

4.3 No Refund Policy

4.4 Chargebacks

Initiating a chargeback will result in permanent ban from all Services with no appeal.

4.5 Delivery

Virtual items are typically delivered within 1-10 minutes. If you don't receive items within 24 hours, contact support.

4.6 Pricing

All prices are in USD and subject to change without notice. Purchases are charged at the price displayed at the time of purchase.

5. Acceptable Use Policy

5.1 Prohibited Activities

You agree NOT to:

• Use cheats, hacks, exploits, or unauthorized mods
• Engage in harassment, bullying, or hate speech
• Share inappropriate content or links
• Spam, advertise, or solicit
• Impersonate staff or other players
• Attempt to crash or lag the server
• Conduct real-money trading (RMT) of virtual items
• Share or sell your account
• Exploit bugs without reporting them
• Use racist, sexist, or discriminatory language

5.2 Consequences

Violations may result in:

• Warning
• Temporary suspension
• Permanent ban (no refund)
• Legal action in severe cases

5.3 Staff Authority

Server staff have final authority on rule enforcement. Staff decisions are final unless overturned by senior administration.

6. User-Generated Content

6.1 License Grant

By creating content on our server (builds, chat messages, etc.), you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content.

6.2 Content Moderation

We reserve the right to remove any content that violates these Terms or applicable law.

6.3 Responsibility

You are solely responsible for content you create. We are not liable for user-generated content.

7. Intellectual Property

7.1 Our Rights

All content, code, designs, logos, and materials are owned by DomainSMP or licensed to us. Unauthorized use is prohibited.

7.2 Minecraft Trademark

DomainSMP is not affiliated with, endorsed by, or sponsored by Mojang AB or Microsoft Corporation. Minecraft® is a trademark of Mojang AB.

8. Service Availability & Modifications

8.1 No Guarantee of Uptime

While we strive for 99% uptime, we do not guarantee uninterrupted service. Server may be down for:

• Scheduled maintenance
• Emergency repairs
• Technical issues
• DDoS attacks or security threats

8.2 Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without prior notice.

8.3 Resets & Wipes

Server resets or wipes may occur. We will provide advance notice when possible, but no compensation is provided for lost progress.

9. Data Collection & Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy.

• Minecraft username
• IP address
• Purchase history
• Chat logs and gameplay data

9.2 GDPR Rights (EU Users)

If you're in the EU, you have rights under GDPR including data access, deletion, and portability.

10. Limitation of Liability

10.1 Maximum Liability

Our total liability shall not exceed the amount you paid in the last 30 days, or $100, whichever is less.

10.2 No Warranties

Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

11. Dispute Resolution & Arbitration

11.1 Informal Resolution

Before filing a claim, contact us at support@domainsmp.org to resolve disputes informally.

11.2 Binding Arbitration

Any disputes will be resolved through binding arbitration, not courts.

11.3 Class Action Waiver

You waive the right to participate in class actions. All disputes must be brought individually.

11.4 Opt-Out

You may opt out of arbitration within 30 days by emailing: legal@domainsmp.org

12. Termination

12.1 Termination by You

You may stop using our Services at any time. No refunds will be provided.

12.2 Termination by Us

We may suspend or terminate your access immediately for violations of these Terms.

12.3 Effect of Termination

Upon termination, you lose access to all virtual goods with no compensation.

13. Changes to Terms

We may update these Terms at any time. Changes are effective immediately upon posting.

Continued use after changes constitutes acceptance.

• Discord announcement
• In-game notification

14. Governing Law & Jurisdiction

14.1 Governing Law

These Terms are governed by the laws of Washington State, USA, without regard to conflict of law principles.

14.2 Venue

Any legal proceedings shall occur in Pierce County, Washington.
